(“We” or “Us”) advise you ("You" or ”Your”) to read these Terms and Conditions in their entirety before completing any step on this Online Prequalification Site (“site”). By using this “site” You agree to all of the following Terms and Conditions, and You are indicating that You have read and agree to them. If You do not agree to these Terms and Conditions, do not access this “site.” You are hereby requesting to submit an online prequalification form to WebBank, through this “site” that is administered by Yamaha Motor Finance Corporation, U.S.A. By completing the online prequalification form You agree as follows:
Authorization to Obtain Credit Report. By clicking the check box following this notice and continuing with the prequalification process, You understand and agree that You are authorizing Us to obtain a soft pull, pre-qualification consumer report from TransUnion. We may use your soft pull, pre-qualification consumer report from TransUnion to authenticate your identity, to match you with financial solutions that appears to be the best fit for your situation, and to identity other offers and services that may be of interest to you. Your soft pull consumer report will not affect your credit score. We shall not use Your soft pull consumer report for the purpose of taking any action with respect to any application for credit.
Services Available via this WebBank Yamaha Credit Card online prequalification site. You understand and agree that this “site” is limited for use as a one-way data entry channel and limits Your use of the “site” to only allow You to complete and submit an online prequalification form for a WebBank Yamaha Credit Card. You agree that an electronic communication from Us in response to Your online submission of the prequalification form will be sent to You while you are on this “site”.
Site Management and Indemnification. You understand that the design and functionality of this “site” is managed by Us. You agree to indemnify, defend and hold Us, including any affiliate companies, directors, officers, employees and agents harmless against any claim, demand, loss, damage, suit, action or other proceeding and any expenses related to Your use of this “site.”
Damages. We are not liable for any loss or liability resulting from any failure of Your equipment or software, or that of an internet browser nor will We be liable for any direct, indirect, special or consequential damages resulting from Your access to or failure to access this “site.”

You are responsible for the installation, maintenance, and operation of Your computer. We are not responsible for any errors or failures from any malfunction of Your computer.

Termination or Discontinuation. We reserve the right to terminate or discontinue this prequalification form and process and access to this “site” at any time.
Governing Law. Use of this “site” and the pre-qualification form shall be governed by the laws of the State of Utah and by applicable Federal laws and regulations.

WE RESERVE THE RIGHT TO CHANGE AND/OR DISCONTINUE OUR CURRENTLY PROVIDED “SITE” AT ANY TIME, FOR ANY REASON.
Intellectual Property. You agree that the “site” and our names and logos are our trademarks and tradenames. You may not copy, initiate or use them without our prior written consent, all rights, title and interest in the “site” and its content and technology is vested in Us or our licensors and You obtain no right, title or interest therein.
Miscellaneous. Our failure to exercise or enforce any right or provision of these Terms and Conditions is not a waiver of that right or provision. If any provision of these Terms and Conditions is found to be invalid, a court should endeavor to give effect to the intention stated in the provision. These Terms and Conditions are binding on successors, legal representatives and assigns.
